1] Heard learned counsel for the appellant.

2] This appeal challenges an award made u/s 140 of the Motor Vehicles Act, 1988. In the meanwhile, the main petition i.e. Motor Accident Claim Petition No.125/2006 has been disposed of by judgment and order dated 19.1.2017.

3] In case, the appellant institutes any appeal against judgment and order dated 19.1.2017, by seeking

FA 2034/10 with CA 4476/08 - 2 - condonation of delay and if such delay is condoned, liberty is granted to challenge the order u/s 140 of the Motor Vehicles Act, in such appeal.

4] With liberty as aforesaid, this first appeal is disposed of. Civil Application No.4476/2008 does not survive and is also disposed of.
