Heard the learned counsel for the applicant, learned APP for the respondent-State and the learned counsel for respondent No.2/victim.

The allegation have been levelled against the applicant that the applicant asked the victim to marry him and scuffled with her. The applicant has been arrested on 01.02.2023. Since then, he is behind bar. No weapon has been used. His further detention would not be fruitful. However, to guard and protect the interest of the victim, certain conditions may be imposed. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant TUKARAM PANDURANG BANSODE be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of the like amount, in Crime No.57 of 2023, registered by Police Station Omerga, District Osmanabad, for the offences punishable under Sections 143, 147, 149, 354, 354-A, 506 of the IPC and Sections 8, 12 of the POCSO Act on the following conditions :

(a) The applicant shall not tamper with the prosecution witnesses.

(b) The applicant shall not contact the victim or any of her relatives till the conclusion of the trial in any other mode or manner.

(c) The applicant shall stay away from village Pethsangvi, Taluka Omerga, District Osmanabad for five (5) months from the date of his release.

(iii) The Secretary, High Court Legal Services, SubCommittee, Aurangabad do pay the legal fees to advocate Mr. Kadam as per the schedule.
