This petition challenges order of the State Government granting permission absorbing respondent no.5 on the vacant post of Sectional Officer in Zilla Parishad Jalna. The petitioners on the day of filing of the petition thought that the said Post ought to have been filled by way of promoting one of them as per the procedure. Learned counsel for the petitioner stated that due to filing of this petition, respondent no.5 was not absorbed and the effect of the impugned order of the Government was kept in abeyance. He also

2 WP 5776/2004 informed that in the mean'time, the petitioners are promoted as per their seniority. In view these developments, the petition now become infructuous, and the same stands disposed of as infructuous.
