The present applicant, who is arrested by Amalner Police Station, Dist. Jalgaon in Crime no. 74 of 2015 for the offences punishable under section 376, 363, 366-A of the Indian Penal Code and under section 3,4 of the Protection of Children From Sexual Offences Act, is praying for his release on bail.

Applicant was arrested on 14/6/2015 and the

2 Cri. Appln. 1491-2016 chargesheet is already filed.

The statement of the victim of the offence would show that at the time of commission of the offence, she was 17 years old and she had love affair with the present applicant and out of the said love affair, she eloped with the applicant on 5/6/2015. Thereafter, they went at various places. Ultimately, on 14/6/2015, they were nabbed by the Police at Bhusawal Railway Station, as the complaint was already filed by the father of the victim.

Learned counsel for the applicant submits that the investigation is already completed and considering the nature of the allegations, he may be released on bail.

Learned A.P.P. submits that the victim is minor and, therefore, prima facie strong material is there against the applicant.

Considering the fact that the investigation is complete and trial may take its own time, in the

3 Cri. Appln. 1491-2016 background of the case, as detailed supra, the application is allowed.

The applicant be released on bail in Crime no. 74 of 2015 registered with Amalner Police Station, Dist. Jalgaon for the offences punishable under section 376, 363, 366-A of the Indian Penal Code and under section 3,4 of the Protection of Children From Sexual Offences Act, upon his executing P.R. bond in the sum of Rs.15,000/- (Rs. Fifteen Thousand) and also upon furnishing surety in the like amount.

The applicant shall not enter the territorial limits of city of Amalner, Dist. Jalgaon without the prior permission of the concerned Sessions Court except on the date/s of hearing of the case.

Application stands disposed of accordingly.
