The applicant has prayed for suspension of sentence and stay to the execution of the order of the Trial Court and Appellate Court. The applicant is sentenced for the offence punishable under Section 379 of the Indian Penal Code and directed to undergo rigorous imprisonment for three months and fine amount of Rs.500/-. The applicant was absconding. However, the learned counsel for applicant submitted that as per application Exhibit-65, the applicant has appeared in the Court of learned Judicial Magistrate First Class, Muktainagar, District Jalgaon in R.C.C. No.245 of 2009. He has submitted a certified copy of the surrender application and order passed thereon below Exhibit-65 dated 11th March, 2024. The learned counsel for applicant submitted

951 APPLN.1033.2024.odt that the applicant is ready to abide all the conditions and will follow the directions of this Court.

Considering the nature of crime, the application deserves to be allowed in terms of prayer clause (C).

During pendency of the criminal revision application, the execution of sentence awarded to the applicant is suspended and the applicant be released on bail on executing P. R. bond of Rs.25,000/- with one surety of the like amount. The bail bond shall be furnished before the Trial Court.
