Learned Counsel for the petitioner, on instructions, seeks leave to withdraw the present petition. Learned Counsel submitted that inadvertently the present petition came to be filed though the petitioner has already approached the alternate Forum and has filed appeal before the Additional Commissioner at Aurangabad.

Mr. Reddy, learned Counsel appearing for respondent No.5 has opposed for such withdrawal stating that knowingly the present petition has been filed.

Admittedly, no interim relief has been passed in the present matter. Even notice is also not issued till date. However, it has to be observed that the Counsel, who has filed the present petition, should have been more careful while filing the present petition.

Leave granted. The petition stands disposed of as withdrawn.
