In view of the above, though Mr.Suryawanshi, learned Counsel for the petitioner sought to canvass the submissions on merits, we are not inclined to consider the same.

Keeping the liberty of the petitioner to avail of the alternate remedy open, the Writ Petition is disposed. All contentions of the parties are kept open. No costs.
