The present petition has been filed taking exception to the award passed by the Labour Court in Reference (IDA) No.111/1989. The present respondent had filed the aforesaid Reference Application seeking his reinstatement with continuity of services and backwages. Vide the impugned award passed on 11.4.1997 the Labour Court at Aurangabad had directed reinstatement of the respondent with continuity of service with 50 per cent backwages. In the present petition though vide order passed by this Court on 22nd of July, 1998, ad interim stay restricted to the backwages was granted by this Court, Shri C.V.Thombre, learned Counsel appearing for the petitioner, fairly brought to the notice of the Court that subsequently an application under Section 17-B of the Industrial Disputes Act was filed by the respondent and the same was allowed.

Having regard to the facts as aforesaid it does not appear to me that anything has remained to be considered in the present petition. By passage of time, the writ petition has become infructuous. The Writ Petition, therefore, stands disposed of.
