Heard Mr. Madhav Ghode, holding for Mr. P. K. Joshi, learned counsel for applicant and Mr. G. S. Shete, holding for Mr.Bharaswadkar, learned counsel for respondent. It seems that the applicant has deposited Rs.3,00,000/- with the Registry while preferring First Appeal No.91 of 2003. Subsequently, the appeal came to be transferred to the District Court Kopargaon in view of the increase in the pecuniary jurisdiction of the District Court. Further, it is revealed that after transmission of first appeal to the District Court Kopargaon, Special Civil Suit No.153 of 1996 came to be withdrawn by the plaintiff. The judgment and decree passed in Special Civil Suit No.153 of 1996 came to be set aside. As such, no cause is remained.
