Learned counsel appearing for the Petitioner, on instructions, seeks liberty to withdraw the Petition, with further liberty to take appropriate remedy for filing discharge application before the trial Court.

The Writ Petition is dismissed as withdrawn, with liberty as prayed for. However, we make it clear that this liberty will be available to the Petitioner to file application for discharge for four weeks from today.

Since the Respondent No.2 has not caused appearance, the amount of Rs.5000/-(Rupees Five Thousand only) which is deposited by the Petitioner in the Registry of this Court, be returned to the Petitioner.
