Heard the learned Counsel for the respective parties. 2.

By way of present petition, the petitioner assails order dated 15.02.2023 passed below Exhibit 43 by the Joint Civil Judge Junior Division, Parola in Regular Civil Suit No. 7 of 2018, whereby the Commissioner can be appointed.

Both the learned Counsel submit that the suit is kept for evidence but it could not proceed further due to the interim order dated 11.04.2023 passed by this Court.

The trial Court to proceed with the matter.

Both the learned Counsel agree that after both the parties lead their evidence, the order dated 15.02.2023 passed below Exhibit 43 by the Joint Civil Judge Junior Division, Parola in Regular Civil Suit No. 7 of 2018 can be given effect after parties lead their evidence and till then the said order be kept in abeyance. 6.

The Writ Petition is disposed of.
