ORDER:- 1.

Heard learned Counsel for the applicant - wife. The respondent - husband, though served with notice, remained absent.

The applicant - wife is seeking transfer of Marriage Petition No.1298 of 2020 pending in the court of Civil Judge (Senior Division) at Pune fled by respondent husband for restitution of conjugal rights, to the Family Court at Jalgaon. According to the applicant-wife, she is residing at Jalgaon which is 400 kms away from Pune. Moreover, she has also fled two proceedings against the respondent husband at Jalgaon. One is complaint under Section 498-A of I.P.C. and another is under the provisions of Protection of Women from Domestic Violence Act, 2005. It is pointed out that the

(2) 975 MCA-80.2022.odt respondent - husband is attending the dates of the proceedings at Jalgaon. As such, considering the convenience of applicant, following order is passed.

ORDER

(i) The application is hereby allowed.

(ii) The Marriage Petition No.1298 of 2020 pending in the Court of of Civil Judge (Senior Division), Pune is transferred to the Family Court at Jalgaon for disposal according to law.

(iii) The respondent is directed to appear before the learned Family Court at Jalgaon on 21st November 2022.

(iv) The application is disposed of accordingly.
