Heard learned Counsel for the petitioner and learned AGP for the respondents / State. By way of this petition, the petitioner has raised grievance against the respondents for not providing adequate staff including Medical Officers. As a result, common citizens of Jalgaon city are not getting proper treatment in the Civil Hospital, Jalgaon.
According to the petitioner, there are 33 posts of Class II Medical Officers and 18 posts of Class I Medical Officers in the Civil Hospital, Jalgaon, as sanctioned by
the Government of Maharashtra. However, out of 18 posts of Class I Medical Officers, only 5 posts have been filled in and 13 posts are vacant; and out of 33 posts of Class II Medical Officers, 18 posts are vacant. The learned Counsel for the petitioner has invited our attention to the position of vacancies stated in Annexure "A", pages 21 to 23 of the petition.
Upon careful perusal of the pleadings in the petition and Annexure "A" to the petition, it appears that there are vacant posts of Medical Officers in the Civil Hospital at Jalgaon. The State Government is supposed to give utmost priority to the health of citizens. In our considered opinion, the grievance raised in this petition deserves to be taken care of by the respondents No.1 to 4.
In that view of the matter, we direct respondent No.1 to ensure that, the process to fill up the posts of Medical Officers is initiated, as expeditiously as possible; however, within four months from today.
So far as prayer clause (B) in the
petition is concerned, we make it clear that, we have not expressed any opinion and it is for the concerned officer to take recourse to an appropriate remedy for redressal of his grievance. Public Interest Litigation stands disposed of on above terms.
