Under this application, the applicant is seeking condonation of delay of only 81 days in filing Second Appeal. 3.

The learned counsel for the respondent though opposed the application strongly, but his objection can be considered at the admission stage. As such, the application is allowed in terms of prayer clause B and disposed of, subject to cost of Rs. 500/- (Rupees five hundred) to be deposited with Registry of this Court for the utilization of High Court Dispensary, Bench at Aurangabad.
