Heard both sides.

The present applicant who is arrested by Shrirampur City Police Station, Taluka Shrirampur, District Ahmednagar in Crime No. II-51/2015, registered for the offences punishable under section 3, 4, 5, 7 of the Prevention of Immoral Traffic Act, is praying for her release on bail.

Learned counsel for the applicant submits that the applicant had withdrawn her earlier application bearing Criminal Application No. 359/2016 vide order dated 4th February, 2016. The present applicant is, however, behind the bars since 18th April, 2015. 4.

The allegations are that the present applicant was soliciting the customers alongwith certain other female associates and one Sanjubai, who is alleged to be running the brothel and was caught red-handed on the spot. Learned counsel for the applicant pointed out that vide order dated 8th February, 2016, passed in Criminal Application No. 46 of 2016, this Court has directed to release said Sanjubai, finding that she was behind the bars for more than ten months and the maximum sentence for the offence is of five years.

Learned A.P.P. opposed the application.

Considering the overall facts on record, in my view, the present applicant deserves to be released on bail. Hence, the following order.

The applicant be released on bail in Crime No. II-51/2015, registered with Shrirampur City Police Station, District Ahmednagar for the offences punishable under section 3, 4, 5, 7 of the Prevention of Immoral Traffic Act, on her executing P.R. bond in the sum of Rs. 15,000/- (rupees fifteen thousand) and also upon furnishing surety in the like amount.

The present application is accordingly allowed and disposed of.
