2025:BHC-AUG:20481-DB 923-WP-4257-2025.odt
IN THE HIGH COURT OF JUDICATURE OF BOMBAY
BENCH AT AURANGABAD 923 WRIT PETITION NO. 4257 OF 2025 SUHAS JAGANATH LANGADE
VERSUS
THE STATE OF MAHARASHTRA THROUGH ITS PRINCIPAL SECRETARY AND OTHERS ....
Mr. K. D. Khade, Advocate for the Petitioner Mr. A. B. Girase, Government Pleader for the Respondents - State ....
CORAM : MANISH PITALE AND Y. G. KHOBRAGADE, JJ.
DATE : 01.08.2025 PER COURT :- 1.
By this Petition, the Petitioner has challenged order dated 16.02.2024, passed by Respondent No.3 District Collector, Beed.
2.
Before this Court can enter into the correctness or otherwise of the impugned order, a basic question that arises for consideration is, as to what is the basis for the Petitioner herein to claim compensation for acquisition when there does not appear to be any material on record to show the Petitioner's claim as regards
(( 2 )) 923-WP-4257-2025 title in the subject property. The documents on record are wholly inadequate for the Petitioner to raise any such claim. 3.
If the Petitioner has any right in respect of a specific piece of land, which according to him has been acquired without payment of compensation, in the first place he will have to show a semblance of material to support his claim regarding title to such piece of land. 4.
There is nothing on record and therefore, we declined, to exercise writ jurisdiction.
5.
At this stage, the learned counsel for the Petitioner submits that he will withdraw the Writ Petition in order to file an appropriate proceeding before the competent Civil Court to prove his claim as regards the subject land.
6.
This Writ Petition is disposed of as withdrawn with liberty to the Petitioner to approach the competent Civil Court. [ Y. G. KHOBRAGADE, J. ] [ MANISH PITALE, J. ] SMS
