The learned APP placed on record an order dated 23.09.2025 passed by the Division Bench (Coram: Sandipkumar C. More and Mehroz K. Pathan, JJ.) in Criminal Appeal No.1/2023. The Court had directed to send the record and proceedings to the concerned trial Court and further directed to conduct the trial, and after conclusion of the trial, send the record and proceedings back to this Court.

The application of the present applicant for grant of bail was decided by the trial court by its order dated 04.01.2025. In view of the fact that the record and proceedings have been received by the trial court pursuant to the above directions, any fresh application for bail on this ground would be required to be considered by the trial court.

Learned advocate for the applicant, therefore, seeks leave to withdraw the application. Leave is granted. The application is dismissed as withdrawn.
