Order :-

1. Mr. Deshmukh, learned counsel for respondent - Corporation submits action has been taken under section 81-B of the Maharashtra Municipal Corporations Act (for short "said Act) and the petitioner herein has alternate remedy under section 81-F of the said Act. 2.

In view of the above, learned counsel for petitioner seeks leave to withdraw the writ petition with liberty to file appeal before the District Judge.

The writ petition stands disposed of as withdrawn with liberty as aforesaid.

The Court where the appeal would be filed, shall consider the time spent in prosecuting the present writ petition. All the contents of respective parties are kept open. No costs.
