BENCH AT AURANGABAD 925 ANTICIPATORY BAIL APPLICATION NO. 386 OF 2025 Vikas Satish Kamble

VERSUS

The State Of Maharashtra ...

Advocate for Applicant : Mr. More P. P.

APP for Respondents-State: Mr. A.A.A.Khan Advocate for Assist to APP : Mr. N. B. Patekar ...

WITH CRIMINAL APPLICATION NO. 988 OF 2025 IN ABA/386/2025 ....

CORAM : ARUN R. PEDNEKER, J.

Dated : March 26, 2025.

PER COURT :- 1.

Criminal Application No.988/2025 is filed for Assist to learned APP. Said application is allowed and disposed of .

2.

Heard the learned Counsel for the applicant, learned APP for the respondent-State, and the learned Counsel for Assist to learned APP. 3.

The applicant is apprehending arrest in connection with FIR No.429/2024, dated 30/06/2024, registered at Police Station Gandhi Chowk, Latur, District Latur, for the offences punishable under sections 307, 324, 147, 148, 149, 323, 504, 506 of IPC.

4.

The case against the applicant and others is that while a meeting was 1 of

925 ABA 386-2025 being held among a group of people to discuss the conduct of a function, namely the birth ceremony in commemoration of Annabhau Sathe, different groups had assembled at the place to decide the President of the Committee responsible for organizing the function. During the meeting, one Mr. Kshirsagar was elected as the President. It is alleged that the accused persons wanted someone else to be elected as President, leading to a disagreement that escalated into a fight. 5.

The applicant and others were allegedly carrying weapons and assaulted various persons. In the said fight, one Akash Shivaji Londhe suffered grievous injuries, purportedly at the hands of the present applicant. The learned Counsel for the applicant submits that the applicant is a politically influential person and belongs to a political party. While he admits to being present at the scene as a committee member, he denies any involvement in the assault. It is also submitted that four knives have been recovered. Furthermore, the injured Akash Londhe was hospitalized from 30/06/2024 to 25/07/2024 and has since been discharged. The applicant contends that he has been falsely implicated in the matter. 6.

The learned APP has produced the injury certificate on record at page No. 37. The injury certificate indicates that Akash Londhe suffered an injury on the right side of the abdomen's lateral wall, measuring 6 x 3 x 6 cm. The injury was caused by a hard and sharp weapon and is grievous in 2 of

925 ABA 386-2025 nature.

7.

The contents of the FIR are corroborated by the injury certificate. Considering the gravity of the offence and the evidence, the applicant's involvement is prima facie established in a grave offence. As such, at this stage, it is difficult for this Court to entertain the anticipatory bail application. Accordingly, the application is dismissed. ( ARUN R. PEDNEKER, J. ) vj gawade/-.
