Petitioner claims that in view of the Government policy declared on 07.02.2014, it would be permissible to accord permission for opening of the school at a place as requested by petitioner in his application. It is further contended that in view of th revised policy, the application tendered by petitioner was not liable to be rejected. Since the application tendered by petitioner has already been dealt with in accordance with the policy prevailing prior to 2015, it would not be prudent to direct re-consideration of the earlier application tendered by petitioner. However, it would be open for the petitioner to tender application to the State Government seeking permission to open a school, in accordance with the policy framed on 07.02.2014, as and when the State Government decides to call applications from the eligible institutions by issuing advertisement in that behalf.
