( 1 ) wp2723.14
IN THE HIGH COURT OF JUDICATURE AT BOMBAY
BENCH AT AURANGABAD WRIT PETITION NO.2723 OF 2014 HEMANT NAMDEORAO KHILLARE
VERSUS
THE STATE OF MAHARASHTRA AND OTHERS Mr.Vinod B. Jadhav, Advocate for the petitioner Mr.K.B.Jadhavar, AGP for the respondent/State CORAM : SUNIL P. DESHMUKH & S.M.GAVHANE,JJ.
DATED :
14.12.2018 P.C. :- .
The deceased had been working as a Class-II servant, who was a Lecturer. He had died in 2001. It is referred to that after employee's death his wife had moved for compassionate appointment in 2001. However, the same had not been considered and subsequently it has been claimed that the petitioner had moved the Management for the appointment on compassionate ground in 2003,2004, 2005 and 2006. 2.
Looking at aforesaid it appears that with the passage of time the matter loses expediency. Additionally it is being contended on behalf of the respondent that such compassionate appointment is available only in case of death of class-III and
( 2 ) wp2723.14 Class-IV employees.

It appears that the petition suffers from laches. We are, therefore, dis-inclined to exercise discretion any powers. The petition is disposed of. [S.M.GAVHANE,J.] [SUNIL P. DESHMUKH, J.] VishalK/wp2723.14
