Heard the learned counsel for the respective parties. 2.

The inquiry officer is present in the court. Mr. D.B. Thoke, learned counsel, on instructions of inquiry officer makes a candid and fair statement that notices were directed to be issued to the petitioner through the society. However, it appears that the notices were not issued to the petitioner.

In view of the same, the learned counsel for respondent No. 3 submits that he will reconduct the inquiry from the stage of inquiry under section 72 (2) of the MCS Act. The learned counsel for the petitioner submits that the petitioner would submit his defence within 15 days from today. Thereafter, the inquiry officer to proceed further in accordance with law.

In view of the same, the writ petition is disposed of, with above observations.
