IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 3404 OF 2015 GENSTRU CONSULTANTS PVT LTD, PUNE

VERSUS

UNION OF INDIA AND ANOTHER ...

Advocate for Petitioner : Mr. Sakolkar A. V.

ASG for Respondents: Mr. S.B. Deshpande .....

CORAM : R. M. BORDE AND V. K. JADHAV, JJ.

DATED : 27th MARCH, 2015 P.C. :- Learned counsel for the respondents, on instructions, informs that the work order has been issued to another bidder, who has not been impleaded as party respondent in the petition, on 3.9.2014 and that substantial work has already been completed. The period prescribed for completion of work under the tender is for six months, however, the Superintending Archaeologist, Archaeological Survey of India, has granted extension for completion of work till 31.7.2015. In this view of the matter and in view of the fact that the successful bidder has not been impleaded as party respondent in the petition, the petition need not be entertained. Keeping the option open for the petitioner to avail of the alternate remedy, writ petition stands rejected.
