Learned counsel appearing for the petitioner/Corporation has tendered across the bar the communication received to her from the Divisional Controller, Maharashtra State Road Transport Corporation, Aurangabad. Said communication is taken on record and marked 'X' for identification.

Present Writ Petition has been filed by the petitioner/Corporation challenging the Order dated 02/07/1996 passed by the Labour Court, Aurangabad in Complaint [ULP] No. 208/1989, whereby learned Labour Court has converted the punishment of dismissal imposed on the respondent into discharge simplicitor. The Order passed by the Labour Court was initially challenged by the petitioner/Corporation by filing Revision Application before the Industrial Court. However, the same was rejected by the Industrial Court, Aurangabad. Thereafter, the present petition has been filed. Now, it is brought to the notice of the Court that all retiral benefits are remitted to the respondent. It is thus evident that the order of the Labour Court has been virtually complied with.

In view of the above, present Writ Petition has become infructuous. It, therefore, stands disposed of being infructuous.
