This application is filed for early hearing of Second Appeal No.266 of 2010. According to learned Counsel for the applicants, both the Courts below are against the appellants and, therefore, in view of interim relief in respect of handing over possession, the respondents are suffering. However, there are so many old appeals than this appeal are pending, which are in fact from the year 1990.

The Court is taking currently dealing with the Second Appeals upto the year 1994, which are in fact around 125 in numbers. In view of the same, and considering the pendency of older matters the present appeal which is of the year 2010 cannot be taken for final hearing at this juncture. 4.

As such, the application stands rejected and disposed of accordingly.
