Present application has been filed by the original claimant for getting the delay of 240 days condoned in filing first appeal. The claimant intends to challenge the judgment and award passed by the learned tribunal for enhancement. 2.

Learned Advocate for respondent No.1 has strong objection contending that the delay has not been properly explained. Learned Advocate for respondent Nos.2 and 3 served, but failed to appear.

However, taking into consideration the fact that the applicant has suffered disability in the accident and for the reasons mentioned in paragraph No.3, delay stands condoned.
