Heard learned counsel for the petitioners.

By this petition, the petitioners are challenging an order passed as far back as on 10th April 2023, being only an interim order, by the Debts Recovery Appellate Tribunal (DRAT). 3.

We have perused the impugned order. It records the amount due from the petitioners as on 03rd July 2020 to the tune of ₹ 23,62,96,025.84/-. The appeal of the petitioners pending before the DRAT challenges a detailed order dated 26th August 2022, passed by the Debts Recovery Tribunal, Aurangabad, whereby the securitization application filed by the petitioners was dismissed. Having taken into consideration the extent of amount due and the fact that the property of the petitioners already sold did not realize sufficient amount to wipe out the entire debt as claimed, the DRAT directed the petitioners to make a pre-deposit of 12 Crores in ₹ four equal installments of 3 Crores each with the first installment ₹ being payable on or before 01st May 2023.

In the facts and circumstances of the present case, we find that the impugned order passed by the DRAT is a reasonable order and sufficient indulgence has been shown to the petitioners, considering the extent of total amount due from them.
