Heard learned Counsel for the applicants - appellants. 2.

The application is filed for condonation of delay of 1320 days in filing the present appeal. According to the learned Counsel for the applicants, the delay has been caused since the sole appellant had died and his legal representatives were not brought on record.

The respondents despite service remained absent and therefore no oppose to this application.

However, considering the huge delay the application is stands allowed in terms of prayer clause-A, subject to deposit of cost of Rs.2,000/- (rupees Two Thousand only) to be paid to the Registry of this Court for utilization of High Court Dispensary, Bench at Aurangabad, within two weeks. 5.

The Appeal from Order be registered after removal of office objections, if any, and after deposit of cost. 6.

List the Civil Application No. 3382 of 2023 on 18th July, 2024.
