The learned Advocate for the Applicant submits that specific reasons have been set out in the Civil Application for seeking leave of this Court to withdraw the petition. Most of the project work has already been completed. The contention as regards the challenge to the empanelment be kept open, to be

The learned Advocate for the Respondent Company opposes the request.

The Petitioner's challenge in the petition was with regard to the empanelment of the son of the serving Chief Engineer of the Company itself. The Petitioner does not desire to pursue this petition. However, if the same issue crops up in any other proceedings, the said option be kept open. 4.

In view of the above, this Civil Application is allowed and the Petitioner is permitted to withdraw the Writ Petition.

The Writ Petition is disposed off as withdrawn, on instructions. Nevertheless, if such issue crops up touching the aspect of nepotism and any other allied issue, the withdrawal of this petition would not be an impediment in any such subsequent matter.
