DATE :
27th March, 2023.
Per Court:
1.
All these Petitioners are identically placed. In Writ Petition No.3315 of 2023, the Petitioner has put forth prayer clause 'B' as under:- "B) By issuing writ of Mandamus or any appropriate writ, order or directions in like nature, this Hon'ble Court may be pleased to direct the respondent No.3 to decide the proposal dated 5/8/2014 of the petitioner forwarded by the respondent no.4 for regularize the break in service during transfer period for giving regular benefits of service."
2.
It is contended that the proposal dated 5th August, 2014 has been forwarded by the Zilla Parishad, Aurangabad to Respondent No.3. The proposal pertains to bridging the break in service suffered by the Petitioners on account of their transfer from the Aurangabad Zilla Parishad to Nashik Zilla Parishad. It was alleged that such transfer orders have been forged and the Petitioners were returned back to Aurangabad. In this period, they suffered a break in service. 3.
In view of the above, these Petitions are disposed off. The proposal forwarded by the Zilla Parishad dated 5th August, 2014, which
is pending for 8 years with Respondent No.3, shall be decided by the said authority by following the due procedure laid down in law, as expeditiously as possible, and preferably within 60 days. [ SANJAY A. DESHMUKH, J. ] [ RAVINDRA V. GHUGE, J. ] nga
