Heard learned Advocate for the petitioner for some time. The application of the petitioner for appointment of Court Commissioner came to be rejected vide order dated 02.12.2024 in RCS No. 336 of 2022 by the Court of learned 4th Joint Civil Judge, Junior Division, Beed. It is submitted that the observations are made in favour of the petitioner, still the application came to be rejected. During the course of arguments, it reveals that the evidence of parties is yet to be commenced. 02.

This Court finds that the petition can be conveniently disposed off keeping it open to the petitioner to apply afresh for appointment of Court Commissioner at appropriate stage. The learned Trial Court to decide the such application on its own merits without being influenced by the observations made in the impugned order.
