This application is filed for transfer of matrimonial proceeding bearing No. A-1626 of 2024 pending in the Court of learned Judge, Family Court, Nagpur to the Court of learned Judge, Family Court, Aurangabad.

This application is vehemently opposed by the respondent. 03.

However, considering that the wife has already filed a proceeding for maintenance which is pending in the Court of learned Judge, Family Court, Aurangabad and the distance between the two places is about 450 kms., this Court is inclined to allow this application. 04.

This application is, therefore, allowed in terms of prayer clause (B). In the Trial Court, the wife shall not seek unnecessary adjournments. If the Trial Court finds that the wife is seeking unnecessary adjournments, the Trial Court shall pass appropriate orders

( 2 ) mca85.25 compensating the husband if he personally remains present in the Court. If husband makes request for appearing through video conference, same shall be considered by the Trial Court liberally. The learned Trial Court is expected to decide the proceeding as early as possible and preferably within a period of one year from today.
