IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD WRIT PETITION NO. 3106 OF 2005 Smt. Jyotibai Ravindra Bhadane

...Petitioner

Versus

The State of Maharashtra & Ors.

...Respondents

.......

Mr. S.P.Tiwari, AGP for the Respondent-State. .......

CORAM :

RAVINDRA V. GHUGE, J.

DATE :

06-07-2019.

PER COURT :

01.

None for the petitioner and respondents No. 4 and 5.

02.

I have perused the impugned Judgment of the District Collector, Nandurbar dated 8.9.2004 disqualifying the petitioner as Sarpanch of the village panchayat for being a mother of three children. Admittedly, the third child, which is a male child, was born on 29.6.2002, which is after the cut off date 13.9.2000 when Sub-clause J-1 was introduced below Section 14(1) of the Maharashtra Village Panchayats Act, disqualifying candidates for having more than two children born after the cut off.

2 24 wp3106-2005 03.

Considering the admitted position, this petition is devoid of merit and therefore, stands dismissed. Rule is discharged.
