DATED : 15 th April, 2015 PER COURT :- 1] By this application, the applicant is seeking cancellation of anticipatory bail granted in favour of respondent no.2 by the learned Additional Sessions Judge, Latur, dated 6.2.2015, in connection with Crime No. 5 of 2015, registered with Shivajinagar police station, Latur, District Latur, for the offences punishable under Sections 420, 419, 468 of the Indian Penal Code.

2] While granting anticipatory bail in favour of respondent no.2, learned Judge of the court below directed the respondent no.2 to attend the investigating officer whenever required.

3] After perusal of the first information report and also after hearing the learned counsel Shri Santosh Bhosale for the applicant, it is clear that the respondent no.2 has not

crap1375.15 induced at any time. Further, the first information report does not disclose at least prima facie the ingredients of cheating. 4] In that view of the matter, no exception can be taken out to the discretion exercised by the learned trial court. 5] Hence, application is rejected.
