By this application, the applicants pray for an early hearing of Second Appeal No.255/2004. It is contended that the applicants are the legal heirs of the original defendant. All of them are above 60 years of age. The applicants would be satisfied if the second appeal is listed on the weekly final hearing board at any time. As such, the applicants do not press prayer clauses B, C and D in the application. 2.

Mr.Bora, learned Advocate has no objection.

In the light of the above, this civil application is partly allowed khs/March 2015/3839-15 (d)

only to the extent of the request in prayer clause "E". Second Appeal No.255/2004 be listed for final hearing in the weekly board commencing from 14/09/2015.
