This writ petition can be disposed of by directing the trial court to frame additional issue about jurisdiction and decide the same alongwith other issues since the trial of the suit has already been commenced. It appears from the written statement filed by the petitioner-defendant that the petitioner has raised the issue of jurisdiction, however, filed an application belatedly for treating the issue of jurisdiction, as preliminary issue.
