We have heard learned AGP for the petitioners and learned counsel for the respondent. Learned counsel for the respondent relies on the judgment delivered by this Court in Writ Petition No. 3338 of 2005, dated 14th February, 2011, wherein, in similar set of facts, the order of the Tribunal was upheld and the said order is affirmed by the Apex Court.

The present matter is also with regard to the condition of break in service. For the reasons stated in the order dated 14th February, 2011 in Writ Petition No. 3338 of 2005, the present writ petition is disposed of.

Rule is accordingly discharged. No costs.
