Heard learned counsel for the parties. It appears that certain offer of allotment had been made to the petitioner and some amount was also got deposited in respect of the same. However, thereafter no further progress had taken place and thus the petitioner has been before this court under present writ petition.

While respondent - M.I.D.C. refers to that the offer letter been given before was without sanctioned layout plan, the matter appears to have travelled further as the petitioner has fled an application showing his willingness to pay the amount as per prevailing rates, said application and / or if any made hereafter, MIDC intends and states those would be considered and decided on.

In view of aforesaid, petition is disposed of. 4.
