IN THE HIGH COURT OF JUDICATURE OF BOMBAY

BENCH AT AURANGABAD 933 WRIT PETITION NO. 3479 OF 2018 MANDANBAI KACHRU TUPE

VERSUS

THE STATE OF MAHARASHTRA AND OTHERS ...

Advocate for Petitioners : Mr. Satish A. Gaikwad AGP for Respondents: Mr. P.N. Kutti CORAM : R.M. BORDE & K.K. SONAWANE, JJ.

DATE : 5th April, 2018.

PER COURT:- The petitioner is objecting to the award passed in the Lok Adalat and the consequential decree passed by the family court at Aurangabad. The petitioner is admittedly not party to the compromise decree. The petitioner claims her entitlement in relation to the property which is subject matter of the aforesaid compromise decree. Since the petitioner is not a party to the same, prima facie, it would not be binding on the petitioner. The remedy for the petitioner, under such circumstances, lies elsewhere and the instant petition cannot be entertained. Keeping the option of the petitioner, open to avail of the remedies available in law, writ petition is disposed of.
