Shri Kawale, the learned advocate for the petitioner, at the outset, expresses his regret that despite this Court having granted four adjournments over a period of two months, there has been no development on the part of the Asset Reconstruction Company (India) Ltd. ('ARCIL') in repaying the loan amounts of the petitioner so as to satisfy the Respondent-Bank. Though the petitioner once again makes a request for an adjournment, Shri Kawale rightly submits that he cannot insist for one more chance. The learned advocate for the Respondent-Bank submits that if the earlier orders of this Court are perused, several

{2} wp343819.odt chances have been granted to the petitioner and the Bank is now not agreeable for extending one more opportunity. He, however, submits in fairness that the Bank will now be attaching the residential property of the petitioner forthwith and after valuation of the property is done, it would proceed to auction the said property. If the petitioner is able to clear off the entire assessed unpaid amounts before the auction, the Bank would consider his case, as they are interested in recovering the amounts and not in disposing off the house property of the petitioner. With the above statement recorded, this petition is disposed off.
