1) The application is filed for transfer of Hindu Marriage Petition No.39 of 2013 presently pending in the Court of the Civil Judge Senior Division Dhule. The said proceeding is filed by husband under section 13 of the Hindu Marriage Act for divorce. It is the case of the wife that she had filed proceeding for restitution of conjugal rights and it is pending in the Court of the Civil Judge Senior Division Jalgaon. She has also filed another

2 MCA 65/2015 proceeding under the provision of the Protection of Women from Domestic Violence Act, 2005.

2) In view of the aforesaid circumstances, this Court holds that for convenience of both the sides all the matters need to be transferred in one Court. So, the application is allowed. Hindu Marriage Petition No.39 of 2013 presently pending in the Court of the Civil Judge Senior Division Dhule is hereby withdrawn from that Court and it is transferred to the Court of the Civil Judge Senior Division Jalgaon where the proceeding for restitution of conjugal rights filed by the wife is pending. The new Court to take care and see that all the three matters are kept on the same day and no inconvenience is caused to the parties. The new Court is directed to dispose of the proceedings within six months from the date of receipt of the record. The parties are to appear in the new Court on 21st November 2015.
