PER COURT :

Applicant apprehends arrest in connection with Crime No. 59/2024 registered with Dhule Taluka Police Station, District Dhule, for the offences punishable under Sections 354-A, 354-D, 324, 504, 506 read with Section 34 of the Indian Penal Code and under Sections 8, 12 of the Protection of Children from Sexual Offences Act.

First Information Report indicates that the incident had occurred on 28.01.2024 wherein the son of the Applicant had

- 2 - allegedly outraged the modesty of the informant. There is allegation that the Applicant assaulted the relatives of the informant. 3.

Learned counsel for the Applicant submits that investigation is complete and charge-sheet is filed. Iron rod used in the assault in question is already seized and as such custodial interrogation of the Applicant is not necessary. 4.

Learned counsel for informant and learned APP opposed the application on the ground that during interim protection, the Applicant is involved in another crime bearing No. 357/2024. 5.

There is no dispute about the fact that investigation is over. Applicant had co-operated in the investigation after his liberty was protected by passing interim order by this Court. The alleged weapon used in the crime is already seized. As such, custodial interrogation of the Applicant is not necessary. Insofar as offence in connection with Crime No. 357/2024 is concerned, undisputedly, in the said crime, Applicant has been granted anticipatory bail by the Sessions Court. This indicates that there is no involvement of the

- 3 - Applicant in the said crime and therefore, he is granted pre-arrest bail.

Having regard to aforestated facts, application is allowed in terms of the interim order.
