The applicant has not been identified by the witnesses nor any incriminating material has been recovered from him. In the circumstances, the applicant deserve bail. Hence, the following order :

ORDER

(i) Bail Application is allowed.

(ii) The applicant, Abhishek @ Abhya s/o. Dastagir Chavan, be released on bail on executing P.B. and S.B. of Rs.50,000/- (Rupees fifty thousand) with one solvent surety in the like amount in connection with Crime No.125 of 2022, registered with Khultabad Police Station, District Aurangabad for the offence punishable under

940-ba-444-2023.odt (2) Section 395, 397 of the Indian Penal Code, on the condition that he shall not tamper with the prosecution witnesses. (iii) The applicant shall attend the trial on each effective date and shall report the nearest police station of his residence on every first and last Monday of the month, between 5 pm to 7 pm, till conclusion of the trial.
