ORAL ORDER :

Heard learned counsel Mr. Choudhari for the petitioners. The grievance of the petitioners was of noncompliance of the order of this Court, dated 16.11.2017. The respondents were directed to initiate proceedings under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.

The notice was issued on 2.7.2018. In response to the notice, affidavit-in-reply on behalf of respondent No.1 M. Devender Singh, Collector, Beed is filed. It is stated in the reply

Contempt Petition No.453/2018 (( 2 )) at para No.6 that, the land acquisition proceeding has been initiated by issuing preliminary notification under Section 11 of the Act of 2013 and published in Government Gazette dated 12th to 18th July 2018. A copy of the gazette is also annexed to the affidavit-in-reply. The learned A.G.P. submits that, within the stipulated period under the Act, the further progress would be completed. The deponent Mr. M. Devender Singh also tenders his unconditional apology for the delay. We accept the unconditional apology tendered by the deponent Mr. M. Devender Singh.

Considering the fact that now the proceeding is initiated and statement is made before this Court that the authority would complete the process within the stipulated period under the provisions of the Act of 2013, the order of this Court dated 16.11.2017 is now complied with and the grievance of the petitioners is redressed, nothing remains in the contempt Petition.
