The learned counsel for the petitioner submits that his claim for time bound promotional pay scale is not considered only on the ground that the petitioner has not produced the validity certificate. The petitioner is appointed on compassionate ground. The learned counsel relies on the orders passed in Writ Petition No. 932 of 2013 dated 04.01.2018 decided at Nagpur.

The petitioner claims to have been appointed in the year 1999. At that time, the reservation

2 wp 3045.18 policy was not applicable to the compassionate appointments as is observed by the Division Bench at Nagpur in Writ Petition No. 932 of 2013.

In the light of above, respondent no. 4 - The Deputy Director of Land Records, Nashik Region, Nashik shall re-consider the case of the petitioner for grant of time bound promotional pay scale on its own merits, in accordance with law and without insisting for submission of validity certificate, if the petitioner is appointed on compassionate ground.

Writ Petition stands disposed of accordingly. No costs.
