The learned counsel for the Applicants submits that the breadwinner of the family met with an accidental death and due to financial constraint, the Applicants could not file the appeal within the period of limitation.
The learned counsel for Respondent No.1 has strongly resisted the application on the ground that the delay has not been explained satisfactorily.
Though Respondent No.2 duly served, none appears for Respondent No.2.
In view of the submissions made on behalf of the Applicants and for the reasons stated in the application, the delay of
44 ca.7618.15.odt 185 days caused in filing the appeal is hereby condoned. Civil application is allowed and accordingly disposed of. In appeal, heard.
