This application is filed under Section 439(2) of Cr.P.C. seeking cancellation of anticipatory bail granted in favour of respondent Nos. 2 to 6, by the Additional Sessions Court, Shrigonda, in Crime No.1065/2018, registered with Shrigonda Police Station, Ahmednagar, for offences punishable under Sections 376, 143, 147, 149, 343, 323, 504, 506 of Indian Penal Code, on 30/10/2018.

Heard learned advocate for applicant, learned Additional Public Prosecutor for State and learned advocate for respondent Nos. 2 to 6.

It is transpired during the course of hearing that applicant/prosecutrix has expired, so also one of the accused persons.

In the present crime, charge-sheet is filed. The case is numbered in the Sessions Court as R.C.C. No.35/2021 and the matter is kept on 15/02/2023 for appearance of accused persons. 5.
Considering the aforestated facts, it is not desirable to cancel the anticipatory bail granted in favour of respondent Nos. 2 to 6 at such belated stage. Application is, therefore, dismissed. (NITIN B. SURYAWANSHI, J.) SVH
