The petitioners have already moved the State Government by presenting an application requesting the State to suspend the Resolution adopted by the Municipal Corporation in the meeting of the Standing Committee on 02.12.2014 being Resolution No.82 in exercise of powers u/s 451 of the Maharashtra Municipal Corporation Act, 1949. Without entering into merits of the controversy involved in the petition, ends of the justice would be met in directing the respondents State to consider the application/representation tendered by the petitioner on 2.12.2014 requesting for suspension of the execution of the resolution or to prohibit doing of act any prejudicial to the interest of the

WP 194.15 + 3239.15.odt Corporation, as expeditiously as possible, preferably within a period of six weeks from today and it is accordingly directed. Both the Writ petitions stand disposed of. It is needless to mention that, while considering representation/application tendered by the petitioner under section 451 of the Maharashtra Municipal Corporation Act, 1949 the State Government is expected to extend an opportunity of hearing to all the parties concerned. 2.

Pending Civil Application do not survive and stands disposed of.
