In view of alternate remedy by way of Appeal provided under Order XLI Rule 1 (s) of the Code of Civil Procedure, learned counsel for the petitioners seeks permission to withdraw the petition with liberty to file Appeal. Allow to withdraw with liberty as prayed for. 2.

In case any delay is there in filing Appeal, the appellate Court may consider the fact that the appellant was prosecuting the remedy by way of present Writ Petition.
