Mr Dighe, learned Counsel for the petitioners submits that the tenders were floated for supply of THR in Beed district. The petitioners being eligible applied. The tender of petitioner no.2 was held to be eligible. On 24.2.2020, the communication was issued to the petitioner no.1 to comply with certain documents. Without waiting for seven days, fresh tender process has been issued. The learned Counsel submits that the respondents be directed to continue with the earlier tender process or the tenders filled in by the petitioners earlier be considered for the tender process. 2.

We have heard the learned A.G.P.

The petitioners do not have vested right. The order was never issued to any of the petitioners nor letter of acceptance was issued to the petitioners. The petitioners are not alleging mala fides against the respondents. The

(945) WP-3654-2020 petitioners will have right to apply pursuant to fresh tender process and can also place on record all the documents, which according to the respondents were deficient during the earlier tender process. 4.
